主旨：有關公立學校教師因病昏迷經家屬向法院聲請監護宣告確定，得否由其監護人代為辦理退休等疑義一案，請查照。
說明：
一、依教育部 105 年 3 月 11 日臺教人(四)字第 1050029680 號函辦理。
二、查學校教職員退休條例(以下簡稱退休條例)第 3 條第 1 項規定：「教職員有下列情形之一者，得申請退休：一、任職 5 年以上，年滿 60 歲。二、任職滿 25 年。」第 4 條第 1 項規定：「教職員任職 5 年以上，有左列情形之一者，應即退休：一、年滿 65 歲者。二、心神喪失或身體殘廢，不堪勝任職務者。」及其施行細則第 5 條規定：「本條例第 4 條第 1 項第 2 款所稱心神喪失或身體殘廢，其認定之標準，均以公務人員保險殘廢給付標準表所定之全殘或半殘為準。所稱不堪勝任職務，係指不能從事本職工作，亦無其他職務可調任或有其他職務可調任，而無能力擔任者。」。
三、次查行政程序法第 22 條規定：「(第 1 項)有行政程序之行為能力者如下：一、依民法規定，有行為能力之自然人。……(第 2 項)無行政程序行為能力者，應由其法定代理人代為行政程序行為。……。」民法第 1098 條第 1 項規定：「監護人於監護權限內，為受監護人之法定代理人。」。
四、綜上，茲以退休條例之適用對象為各級公立學校編制內專任合格及有給之教職員，為保障公立學校教職員退休權益，學校教職員因病昏迷無法為意思表示並經法院為監護宣告，倘符合退休條例第 3 條規定，即得由監護人代為「申請退休」；又倘受監護宣告之教師已達公教人員保險殘廢給付標準表所定半殘廢以上之證明，並經服務學校證明不堪勝任職務，服務學校亦得依退休條例第 4 條第 1 項第 2 款規定辦理「應即退休」。
