一、職場霸凌之定義與認定要件：
(一) 定義：指在工作場所中發生，藉由濫用權力與不公平處罰所造成之持續性冒犯、威脅、冷落、孤立或侮辱行為，致被霸凌者感到受挫、被威脅、受羞辱、被孤立及受傷。
(二) 構成要件（需同時具備）：
1.故意且明顯不當的行為。
2.行為具持續性（長期、反覆），不是偶發事件。
3.在職場中產生明顯敵意的環境。
4.對當事人造成身心影響。
5.行為須經第三人也能認定為不合理，具客觀性。
