說明：
一、依據教育部 112 年 4 月 12 日臺教學(三)字第 1120018507 號函辦理。
二、本條例本次修正第 2 、 5 、 7 、 8 、 14 、 22 、 28 、 31 、 35 、 36 、 38 、 39 、 43 至 45 、 46 至 48 、 51 、 53 、 55 條條文；增訂第 45 條之 1 、第 52 條之 1 及第 53 條之 1 ，除第 22 條規定中途學校之設置、組織及教育相關事項，其子法由教育部國民及學前教育署續依相關時程規定研商修訂之，其施行日期由行政院定之外，其餘條文自公布日施行。
三、茲針對前揭修正條文對學校教育人員及學生權責及權益之影響，摘要說明如下：
(一)修正提高為逕處以刑罰之規定（觸法即涉刑責）：使兒童或少年為性交、猥褻之行為，以供人瀏覽；使兒童或少年被拍攝、自拍或製造性影響等；散布、播送、交付、販賣、公然陳列或以他法供人觀覽、聽聞兒童或少年性影像等、就無正當理由持有兒童或少年之性影響、支付對價觀覽兒童或少年為性交、猥褻行為者（修正條文第 35 條、 38 條、 39 條及第 44 條）。
(二)未盡通報責任之行政裁罰：教育人員無正當理由未通報或未依時限通報者，處新臺幣六千元以上六萬元以下罰鍰。
四、檢附該等修正條文總說明及對照表各 1 份，請各校加強向教職員工生及家長宣導。
